 Hey Stump
I'm sorry to bother you with this, but I came up with a question I couldn't answer. I also thought this could help others, thats why I didn't pm it. Is it legal to drive and drink non-alcoholic beers like O'Doules while driving. Personally, you are the only cop I know, so thats why I'm asking you.

yeah i know im not stump, but drinking beer while driving isnt illegal, but driving drunk is
so if youre not drunk, it should be ok

Kyle, drinking real beer while driving IS illegal, I'm wondering if drinking "fake" beer is illegal. Haven't you ever heard of someone getting busted for "open containers"?

Yep...it's illegal. I charged a guy for open container for having o'douls and he tried to say in court that it is non-alcoholic. If you look at the back label it has .5% alcohol content ...which means it is actually an alcoholic beverage. Needless to say he was found guilty. So the answer once again is YES! Peace on ya!

Correct me if I'm wrong but driving while drinking ALCOHOL is illegal no matter how small the amount, so if there is a "near beer" with absolutely NO alcohol in it, it would be legal correct or no?

hmm, i learned something new today!
so if anything with alcohol is illegal, what about those candies with alittle bit of liquor in the middle? my assumption would be yes, its illegal since theres alcohol involved nonetheless but sounds alittle ridiculous.

When I was in high school I worked at a gas station. We got a shipment of those in, well we live in a dry county. Since the box was already open the manager gave them all to me. I'm still not sure if I puked because of all the different liquor or all the chocolate I ate, but it was a damn fine day.  Somehow I didn't seem to mind pumping gas that day.

Not saying that it is not ridiculous...just telling you the facts in most states. If a "Beverage" has an alcohol content at any level it is considered an alcoholic beverage and thus means that in most states is illegal to be open while driving. Peace on ya...and have a DD if you want to drink (Of age KYLE!)! Don't make me come down there!

Near beer and all of the other "non-alcoholic" beers actually have alcohol in very small contents. The key is the word "alcohol"...No matter the amount. Peace on ya!
